Lindsay BrigmanBiographyLindsay T. Brigman joined Wicker Smith in 2003 and is a Shareholder in the Tampa office. Her practice includes advising on a variety of matters, with a focus on legal malpractice, trucking and auto negligence cases, premises liability, and catastrophic injury. In her more than twenty years of practice, she has tried dozens of cases to verdict throughout Hillsborough, Pinellas, Polk, Orange and Manatee County. Lindsay’s capacity for empathy and nuance makes her particularly adept at navigating emotionally fraught cases with the potential for high damages and public exposure. She combines her emotional intelligence with patience, precision and analytical skill, meticulously putting together a defense strategy to achieve the best possible outcome for her client, whether that is through trial, or early resolution via settlement, summary judgment or dismissal. Whether she is representing a fellow lawyer in a legal malpractice claim, or defending a case involving catastrophic injury or death, Lindsay takes great pride in her meticulous preparation, and knowing all the small details that make a big difference. She understands that a client’s entire livelihood sometimes revolves around how a particular case resolves, and she strives to provide the type of representation she would want if the roles were reversed. Outside of the courtroom, Lindsay devotes significant time to researching the medical billing practices that are commonly used in personal injury litigation. She has successfully argued and won motions that limit the ability of plaintiffs to seek damages in excess of the actual amount of their medical bills, and was instrumental in establishing a precedent for such rulings after Florida enacted tort reform in 2023. Lindsay holds a Bachelor of Arts in Psychology and Criminology from Auburn University, and a Juris Doctor from the University of Florida. When she isn’t working, Lindsay can be found solving the day’s Wordle, or spending time at her family’s home in Highlands, North Carolina with her husband and their two daughters. Representative Matters
Nuclear Verdict Avoided in a Legal Malpractice Matter
We represented a defense lawyer in a malpractice matter in which he faced a $535 million claim arising from an underlying auto claim with unusual and aggravating facts. The Plaintiff alleged the attorney’s misinterpretation of a settlement offer led to the defendant’s exposure to an excess judgment. Summary judgment was sought and subsequently granted by the trial court, and the case was dismissed. Plaintiff appealed, and on October 27, 2023, the Florida Second District Court of Appeal affirmed the lower court’s summary judgment ruling.
