Defense Verdict: Brevard County, Florida (Negligent Security)
Orlando Partner, Mike Tyson, and Orlando Associate, Oscar Draughn, obtained a defense verdict in a negligent security case in Brevard County, Florida, last week.
We represented a property owner in this case that involved a physical altercation that started at a bar and lounge located within our client’s strip plaza and spilled into the parking lot. The two Co-Plaintiffs alleged that they were beaten and stabbed in the altercation, and that our client failed to provide adequate security for their premises that could have prevented the dangerous criminal attack from occurring.
Each Plaintiff was stabbed in excess of five times, and both underwent multiple surgeries and claimed to have sustained traumatic brain injuries as a result of the attack.
Trial lasted nine days and included a site visit so the jury could inspect the premises for themselves. At closing, Plaintiffs asked for a combined total of $32 million, but the jury found no liability on the part of our client and returned a defense verdict.
