Favorable Verdict: Volusia County, Florida (Trucking Negligence)
Orlando partners Kurt Spengler and Kyle Fontaine recently prevailed in an admitted-liability trucking negligence trial in Volusia County, Florida.
This case involved a rear-end collision on the interstate by the insured’s tractor-trailer into the plaintiff’s car, resulting in extensive property damage. Plaintiff claimed permanent neck and back injuries, as well as a TBI, with a future ACDF recommended and future steroid injections, and sought over $1.8 million in damages. While admitting fault, we contested the extent and permanency of the alleged injuries, recommending about $27,000 in past medical expenses. The Jury agreed, awarding $29,000 in past medical expenses and no other damages. These will be reduced after collateral sources are set-off post trial. The amount of the award also triggered our Proposal for Settlement.
