Plaintiff claimed that she slipped and fell on a set of outdoor stairs on a rainy day, alleging that the stairs were maintained in an unreasonably dangerous condition. She alleged that, as a result of the fall, she sustained knee injuries requiring surgery. However, the Court concluded that there was no evidence of any dangerous condition present on the stairs and that the evidence revealed that the Plaintiff fell on an accumulation of rainwater. The Court granted summary judgment, finding that the condition was so open and obvious that it was not inherently dangerous and that there were no hidden defects in the area.
Congratulations Patrick on this great result.
