Wicker Smith Partners Win Summary Judgment in Miami-Dade County
MIAMI – SEPTEMBER 17, 2021 – Congratulations to attorneys, Constantine “Dean” Nickas and Jeffrey Goodman and their litigation team on their summary judgment in Miami-Dade County. The case involved allegations wherein the Plaintiff (then age 24) suffered a fractured left hip and additional injuries to her neck and legs when a motor vehicle exiting our client’s property struck the motor bike on which the Plaintiff was a passenger. She subsequently underwent surgical fixation of her fractured hip among other extended and ongoing treatments resulting in several hundred thousand dollars in medical liens.
The Plaintiff maintained that the incident was caused by overgrown foliage that obstructed the vision of drivers operating vehicles entering and exiting the property. Emphasizing the new summary judgment standard, the trial judge was convinced that there was no genuine dispute as to any material fact and that no reasonable jury could find in favor of the Plaintiff against our clients.
